Terms of Service
These Terms govern your use of the Gaëlle AI marketplace assistant service (“Gaëlle,” “we,” “our,” or “us”). By using the service, you agree to these Terms.
1. The service
Gaëlle is an AI marketplace assistant. You text a photo of an item to Gaëlle’s number, and our AI replies with a ready-to-post listing for online marketplaces and/or an estimate of the item’s market value. The service is provided “as is” and “as available.”
2. Eligibility
- You must be at least 13 years old (16 in the EU/UK) to use the service.
- You must provide accurate information, including a working mobile phone number that you control.
- You are responsible for activity from your phone number.
3. Acceptable use
You agree not to:
- Submit photos depicting illegal goods, stolen items, or content that violates the rights of others.
- Use the service to harass, defame, or harm others.
- Attempt to circumvent rate limits, security controls, or access restrictions.
- Scrape, reverse-engineer, or build a competing service from data obtained through Gaëlle.
- Use the service for unlawful purposes.
4. SMS messaging program
By signing up to receive SMS from Gaëlle — whether via the webform on this site or by texting JOIN to our number — you agree to the terms of our Mobile Messaging Terms and consent to receive transactional SMS from Gaëlle in reply to messages you send. Gaëlle only replies; we do not initiate text messages. Message and data rates may apply. Reply STOP to opt out at any time; reply HELP for help.
5. Content and licenses
You retain ownership of the photos and content you submit to Gaëlle. You grant Gaëlle a non-exclusive, worldwide, royalty-free license to process that content as needed to operate the service. We do not claim ownership of your content and we do not use it to train AI models.
6. AI-generated output
Listing copy, valuations, and other AI-generated outputs are estimates based on the photo and information provided. We do not guarantee accuracy and you are solely responsible for the listings you publish to third-party marketplaces. The output is not appraisal, financial, or legal advice.
7. Termination
You may stop using the service at any time by replying STOP to any Gaëlle SMS or by emailing admin@gaelle.app. We may suspend or terminate access for users who violate these Terms, with notice where practicable.
8. Disclaimers
To the fullest extent permitted by law, the service is provided without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the fullest extent permitted by law, the Company will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the service. The Company’s aggregate liability for all claims arising from the service will not exceed the greater of (a) USD 100 or (b) the amounts you have paid us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless the Company from any claims arising out of your use of the service, your violation of these Terms, or your violation of the rights of any third party.
11. Governing law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in New York County, New York.
12. Changes
We may update these Terms from time to time. Material changes will be communicated via the website or email at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance.
